The Committee on Political Subdivisions moves to amend the
bill on page one, by striking out everything after the enacting
section and inserting in lieu thereof the following:
"Article 7. COMPENSATION OF ELECTED COUNTY OFFICIALS.
§7-7-4a. Full-time prosecuting attorneys.
(a) On or before the first day of January, two thousand nine,
a county prosecutor in class VI - IX county, shall be a full-time
prosecutor. At that time, upon mutual agreement of the prosecuting
attorney and the county commission in a class VI - IX county, the
prosecuting attorney may remain a part-time prosecuting attorney.
The agreement reached between the prosecuting attorney and the
county commission regarding employment status shall remain in
effect for the remainder of the prosecuting attorney's term of
office.
(b) (1) Notwithstanding, the initial determination of full-
time or part-time status as provided for in subsection (a), for
each subsequent term of office, a prosecuting attorney in a class
VI - IX county shall be a full-time prosecuting attorney, unless
the prosecuting attorney and the county commission reach a mutual
agreement that the prosecuting attorney is part-time for that term.
(2) The agreement must be reached between the first day
January and fifteenth day of January of said year. The agreement
reached between the prosecuting attorney and the county commission regarding employment status remains in effect for the remainder of
the prosecuting attorney's term of office.
(c) The county commissions of counties in class VI through IX
shall then compensate all prosecuting attorneys that have changed
to full-time by virtue of this section at the same rate of
compensation established for a prosecuting attorney in a class V
county."
